Contract Disputes

Essentially all transactions — from simple store purchases to complex mergers of multinational corporations — are based on contracts. One party exchanges property or services with another person, and in return he receives a valuable benefit in the form of money or in the form of other property or services.

Sometimes, however, one party will believe that the other party has failed to live up to the bargain — in other words, that the other side has committed a breach of contract. Such disputes can take many forms, including disagreements over the scope of work, disagreements over the quality of services or goods provided, disagreements over the meaning and effect of contractual provisions, and conflicts over payment terms or amounts. These disputes can arise from one party’s refusal to perform, or from a party’s inability to perform, or from a simple mistake or misunderstanding by one or both parties. And when this happens, the parties may look to the courts to interpret and to enforce their agreement.
